This fact is sometimes abused, with or without success, as right now by the CoS. I learned today that after the primary court's decision on Friday to deny the CoS' motion for secrecy on the NOTs, the CoS filed still another motion on Monday, about the same thing. The new motion was denied too, in a decision yesterday. At the same time two more CoS motions were denied: 1) that the court "order measures aimed at preventing infringment to the rights of the plaintiff" and 2) that the court in the future consist of three judges instead of only one. The CoS appealed against the new decision to keep the NOTs public. I learned about the appeal (as I am getting used to in this case) by coincidence. I decided that now is the time to put the lawyer on the case that I had retained already last week. She filed a statement against the CoS secrecy motion, which although delivered within a couple of hours of my learning about the appeal arrived too late: the matter had already been taken into consideration by the judges. A decision was reached this afternoon or early evening, but will be pronounced in the morning. This is the most exciting moment so far: if publicity is upheld, it will also be the greatest victory of reason over the CoS abuse of the law. I'll inform you as soon as I know. At the same time tomorrow morning I will also have a decision on my appeal of the taking my computer material in custody.
